These Terms and Conditions are applicable to the Golf South Ayrshire Season Ticket of South Ayrshire Council (the Council) Golf Courses.
These Terms and Conditions are applicable to the Golf South Ayrshire Season Ticket of South Ayrshire Council (the Council) Golf Courses. Except where expressly agreed otherwise by the Council, in writing, every Season Ticket holder shall be subject to these Terms and Conditions. The Council reserves the right to use discretion in all matters relating to Season Tickets.
Season Ticket Terms and Conditions may be revised from time to time and whilst every effort will be made to make Season Ticket holders aware of any changes, the latest version will be posted on the website.
The Council reserves the right to suspend the sale of Season Tickets at any time.
1.1 Acceptance of an application for a Season Ticket is solely at the discretion of the Council and reasons need not be given for refusal.
1.2 Season Ticket holders agree to comply with and be bound by these Terms and Conditions.
1.3 Season Ticket holders must not share, sell, lend, or otherwise allow another person to use, their Season Ticket card or login details. Any Season Ticket holder found to be doing so will have their Season Ticket cancelled.
1.4 Season Ticket holders must advise us promptly of any change to their personal details, as provided on the Season Ticket application.
1.5 By purchasing a Season Ticket, Season Ticket holders are agreeing to display their name in the tee sheet which is available to view by other Season Ticket holders. Season Ticket holders may book another Season Ticket holder into a tee time, however they require explicit permission to do so.
TERM OF SEASON TICKET AND SUBSCRIPTION FEES
2.1 The Season Ticket year begins on 1st April and invoices are raised in advance.
2.2 Season Ticket holder joins each year for a minimum period of one year unless they join partway through a year, in which case the Season Ticket holder is responsible for their subscription up to the end of the standard yearly period. A Season Ticket holder is responsible for their fees up to 31st March each year.
2.3 Season Ticket holders will be notified by email of any changes to subscription fees; the website will detail any other changes to these Terms and Conditions. Invoices are sent out by email in March for the new season. The website will display the next seasons’ fees and any category changes, once agreed by the Council.
2.4 Season Ticket holders joining after 30th June will pay pro-rata to the nearest month.
2.5 Season Ticket holders must keep their contact details, including their home address and email address, up to date within the ‘Online Members Hub’ or by informing a member of staff. The Council will not be responsible for address errors occurring because of failure by Season Ticket holders to keep contact details updated.
CATEGORY OF SEASON TICKET
3.1 All categories of Season Ticket, playing rights and associated costs are available on the website.
3.2 The Council may offer special concessionary rates from time to time. We reserve the right to require an applicant for the concessionary rate to provide us with appropriate documentary evidence, to our reasonable satisfaction, of their eligibility for the concessionary rate.
METHODS OF PAYMENT
4.1 Season Ticket holders wishing to pay by subscription must do so by recurring card payment.
4.2 All subscriptions must be paid on either 1st or 15th day of each month. Paying by subscription you are agreeing to purchase a Season Ticket up to 31st March.
4.3 The billed amount must be paid in full by 31st March.
4.4 Any payments not received within seven days of becoming due, will result in the suspension of booking rights. If they remain unpaid after one month of becoming due this may result in an administration fee of £30 being applied to the Season Ticket holder’s account.
4.5 If they remain unpaid after two months, the Season Ticket will be cancelled. Any debt outstanding may be referred to the Council’s debt recovery team. A charge of £75 may be applied to the outstanding balance to cover administration fees.
MEDICAL SUSPENSION OF SEASON TICKET
5.1 A Season Ticket may be suspended due to injury/ill health if the duration of being unfit to play exceeds eight weeks and upon production of a Doctor’s letter stating that they are unfit to play golf/use the facilities.
5.2 Season Ticket credit will be given for the period indicated in the letter only.
5.3 Upon death or proof of a debilitating medical condition, your Season Ticket obligations to the Council will end. The balance of any advanced payments will be refunded from the 1st of the month following written notification being received.
6.1 All Season Ticket holders have a fifteen day period in which to revoke a Season Ticket from the date of purchase and receive a full refund. If the Season Ticket holder has played during the period then they will be responsible for the payment of all green fees at the full advertised Non-Member rate.
6.2 In the event that a Season Ticket holder, or the Council cancels a Season Ticket for any reason outside of the terms and conditions, any former Season Ticket holder wishing to re-join must first pay any fees outstanding plus an administration fee of £30.
6.3 Any former Season Ticket holder who has cancelled their membership out with the terms of cancellation may not be signed on at guest rate and will not be permitted to play in any Council organised Open competition or Open Week. They are not restricted from representing another club in a team match or from playing by paying a full green fee or from playing as a member of a visiting society.
6.4 A Season Ticket holder may apply to cancel their Season Ticket due to the circumstances set out in Section 5. In addition, any Season Ticket holder who has been made redundant and is able to provide written evidence from their previous employer outlining the redundancy may apply to cancel their Season Ticket. If, in either of these circumstances, the Season Ticket holder has paid in full, a pro-rata refund for the remainder of the Season Ticket term will be given.
6.5 Season Ticket holder may apply to cancel their Season Ticket if they relocate to out with 50 miles of the Council area and are able to provide proof of their new address.
6.6 South Ayrshire Council reserves the right to cancel or suspend a Season Ticket at any time in the following circumstances:
6.6.1 If a Season Ticket holder commits a serious or repeated breach of these Terms and Conditions.
6.6.2 If a Season Ticket holder knowingly provides false details which would have reasonably affected our decision to grant a Season Ticket to that individual.
6.6.3 If a Season Ticket holder harasses, threatens or abuses a Council Employee or other Season Ticket holder, maliciously damages property, or commits any illegal act whilst on the facilities.
6.7 If the Council terminates a Season Ticket for any of the above reasons, the Council reserves the right to retain all monies that have been paid for that Season Ticket.
6.8 No refund will be given for subscription payments received if Season Ticket is cancelled out with the terms of this cancellation policy.
BOOKING A TEE TIME
7.1 There is no guarantee of access to a specific tee time, or course on any given day. Subject to availability, Season Ticket holders may book a tee time up to 8 days in advance online from 9pm (depending on the category of membership purchased).
7.2 Bookings by phone or in person may be made up to 7 days in advance from when the clubhouse opens. Seasonal variations may apply.
7.3 Non-Member reserved times may be booked at 9pm, two days in advance, if available.
7.4 Season Ticket holders must ensure they have fully read the terms of booking when booking online.
7.5 Each Season Ticket holder may only book one tee time per day per course, subject to availability.
7.6 A Season Ticket holder must only book another Season Ticket holders into their tee time if they have explicit permission to do so from that individual. Any Season Ticket holder found to have made bookings in the name of another Season Ticket holder without the permission of that individual may be reported to the Office of the Information Commissioner for a data protection breach.
NO SHOWS AND CANCELLATIONS
8.1 Season Ticket holders who fail to show for a booked tee time will have a charge of £5 levied to their account, unless the course has been closed by the Council.
8.2 A Season Ticket holder who wishes to cancel a booked tee time must do so more than 2 hours in advance of that tee time. Season Ticket holders who cancel within 2 hours of the tee time, will have a charge of £5 levied to their account, unless the course has been closed by the Council.
GUESTS OF SEASON TICKET HOLDERS
9.1 A Season Ticket holder may not introduce the same guest any more than four times in any one year.
9.2 Season Ticket holders wishing to introduce guests must observe all terms and conditions, in particular:
9.2.1 The Council reserves the right to refuse entry to guests, including former Season Ticket holders and whose Season Ticket has been terminated by the Council;
9.2.2 Guests must pay the appropriate fee as detailed in the list of Green Fees available on the website;
9.2.3 For the duration of the permitted use of the Facilities, guests must observe all Terms and Conditions, as though they were fully paid Season Ticket holders;
9.2.4 Guests must be accompanied on the course by the Season Ticket holder introducing them.
COURSE CLOSURE / INCLEMENT WEATHER
10.1 The course(s) or practice areas may be closed due to adverse weather conditions or for competitions
10.2 In exceptional circumstances the course(s) may be closed for booked play outside of visitors’ times.
10.3 The Council will endeavour to maintain golf courses in the best possible condition. This may, from time to time, result in the closure of holes or parts of holes to make improvements or carry out maintenance works considered to be in the best long term interest of the facility.
HEALTH AND SAFETY
11.1 The Council will endeavour to take reasonable care to provide a safe environment for Season Ticket Holders and guests. Season Ticket holders and guests must abide by all instructions on notices, and signage, and must comply with all information provided for their safety and the safety of others. For their own safety, Season Ticket holders and guests must ensure that they are not in the path of moving golf balls, clubs or buggies at any time.
11.2 The Council accepts no responsibility for injury as a result of ground conditions resultant from prevailing weather conditions or damage caused by burrowing animals. Due care and attention should be demonstrated when accessing the courses at all times, including without limitation, checking the playing surface of the golf course to confirm that is suitable, before commencing play.
11.3 Fire exits in Clubhouses are clearly marked, and in the interest of public safety in the event of fire and/or on hearing the fire alarm, Season Ticket holders and guests are asked to make their way in an orderly fashion to the nearest available exit and comply with all instructions given from staff.
11.4 Course risk assessments are available upon request.
12.1 The times of opening and closing of facilities are listed on the website and published on notice boards. The Council reserves the right to vary these times.
12.2 Emergency closure of premises or facilities in the event of adverse weather conditions, repair and/or maintenance issues and/or Government advice (such as circumstances relating to the Covid-19 pandemic) will be announced as soon as possible prior to closure. In an emergency, the Council reserves the right to close premises or facilities without prior notice.
13.1 Season Ticket holders and guests are reminded that they are solely responsible for the security of their personal possessions and equipment. Season Ticket holders and guests are responsible for the security of their vehicles and contents parked in the Council’s car park.
14.1 All Season Ticket holders and their paying guests are provided personal liability insurance for playing golf on a golf course owned by the Council in respect of third party injury, property damage and personal accident.
14.2 All incidents or accidents, including all instances where a golf ball has left the confines of the course, must be reported to a member of staff.
14.3 Contact details for the insurers will be provided at each golf course owned by the Council and insured golfers or third parties should contact the insurers direct to report an incident or accident within 14 days.

GENERAL RULES APPLICABLE TO ALL COURSES
15.1 All rounds of golf must be pre-booked either online, on the phone or in person.
15.2 All games must commence from the 1st tee and at their allotted tee time.
15.3 Each player must have a golf bag with a minimum of four clubs. One of which must be a putter.
15.4 All trolleys must be kept off the tees, greens and putting surfaces at all times. Trolleys are not permitted in areas marked as GUR.
15.5 Golf bags are permitted on the tees, however they must be kept off the greens and putting surfaces at all times.
15.6 Four players is the maximum allowed for each match.
15.7 Play will be under the rules of Golf as prescribed by the R & A, Local Course rules and any instructions issued by the golf course Starters and Marshals.
15.8 Single Players have no status on the golf course and must give way to 2, 3 and 4-ball matches at all times.
15.9 Single Players must not play more than one ball unless there is a clear hole in front of and behind them, in any case single players must not play any more than 2 golf balls.
15.10 Practising on courses is not permitted at any time.
15.11 Golf greens must not be used as practice putting or chipping greens.
15.12 Players must always wait until the players in front are out of range before hitting their shot.
15.13 Mobile telephones must be switched to silent for the duration of play.
15.14 Players failing to comply with these rules may be denied future use of the Council’s golf facilities.
APPLICATION OF CONDITIONS AND OUR OBLIGATIONS
16.1 These Season Ticket Terms and Conditions shall prevail over any inconsistent terms or conditions contained or implied by law, trade custom, practice or course of dealing. This will not affect your statutory rights.
16.2 The Council may, from time to time and without notice or penalty, change all or part of the facilities provided by it under these Terms and Conditions in order to comply with any applicable safety or statutory requirements, provided that such changes do not materially affect the nature or scope of the facilities, including without limitation strikes, lock-outs or other industrial action by Council Employees, third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or pandemic or any other natural disaster, or failure of public or private telecommunications networks.
16.3 The Council shall notify you of any changes in the manner we deem most appropriate, which may include emails, updates to our website or signs within the club.
16.4 The Council shall use reasonable endeavours to provide access to the facilities but Season Ticket holders must acknowledge that the Council is not responsible for circumstances beyond its control. If the Council’s ability to provide the facilities is affected by circumstances beyond its control, it will not be responsible for any delay or disruption. The Council will contact Season Ticket holders as soon as possible to advise them of any delay or disruption to the service. If the delay or disruption is substantial the Council will consider, what if any, refund is appropriate for the period which there was limited or no access to the facilities.
17.1 Complaints should be brought to the immediate attention of a member of staff. All complaints will be dealt with through the Council’s Complaints handling procedure.
HOW INFORMATION ABOUT SEASON TICKET HOLDERS WILL BE USED
18.1 We take the privacy of our Members seriously and will only use the personal information you supply to us to administer your account, to provide you with access to our golf facilities and if agreed to provide the products and services you have requested from us.
18.2 To find out what to expect when the Council collects your personal information and how we process and protect your information, please visit our website at – https://www.south-ayrshire.gov.uk/terms/policy/
18.3 However, from time to time we would like to contact you with details of other Golf activities, offers and competitions that we provide. We will only do this if you give us your consent. If you consent to us contacting you for this purpose you will be asked to tick the relevant box and to choose how we may be able to contact you at time of registration.
18.4 If you do consent, please note you can withdraw your consent at any time by contacting email@example.com or by contacting a member of Golf staff at our facilities. Please note that all processing of your personal data in relation to direct marketing will cease once you have withdrawn consent, but this will not affect any personal data being processed out with this purpose.

19.1 These Terms and Conditions shall be governed and construed in accordance with the law of Scotland and shall be subject to the exclusive jurisdiction of the Scottish courts.
