These Terms and Conditions are applicable to the Golf South Ayrshire Season Ticket of South Ayrshire Council (the Council) Golf Courses.

These Terms and Conditions are applicable to the Golf South Ayrshire Season Ticket of South Ayrshire Council (the Council) Golf Courses. Except where expressly agreed otherwise by the Council, in writing, every Season Ticket holder shall be subject to these Terms and Conditions. The Council reserves the right to use discretion in all matters relating to Season Tickets.

Season Ticket Terms and Conditions may be revised from time to time and whilst every effort will be made to make Season Ticket holders aware of any changes, the latest version will be posted on the website.

The Council reserves the right to suspend the sale of Season Tickets at any time.

SEASON TICKET

1.1 The granting of an application for a Season Ticket is at the discretion of the Council. Reasons will be given for refusal upon written request.

1.2 Season Ticket holders agree to comply with and be bound by these Terms and Conditions.

1.3 Season Ticket holders may not share, sell, lend, or otherwise allow another person to use, their Season Ticket card or login details. Any Season Ticket holder found to be doing so will have their Season Ticket cancelled.

1.4 Season Ticket holders are asked to advise the Council of any change to their personal details at the earliest opportunity.

1.5 By purchasing a Season Ticket, Season Ticket holders are agreeing to display their name in the tee sheet which is available to view by other Season Ticket holders. Season Ticket holders may with their consent book another Season Ticket holder into a tee time.

TERM OF SEASON TICKET AND SUBSCRIPTION FEES

2.1 The Season Ticket year begins on 1st April and ends on 31st March. All invoices are raised in advance.

2.2 A Season Ticketholder joins each year for a minimum period of one year unless they join partway through a year, in which case the Season Ticket holder is responsible for their payment subscription up to the end of the standard yearly period.

2.3 Season Ticket holders will be notified by email of any changes to the cost of a season ticket and any changes to these Terms and Conditions will be provided prior to purchase. Invoices are sent out by email in March for the forthcoming season. The website will also display the fees and any category changes, once agreed by the Council.

2.4 Season Ticket holders joining on or after 1st July will pay the cost of the Season Ticket pro-rated to the end of the membership term.

2.5 It is the responsibility of Season Ticket holders to keep their contact details, including their home address and email address, up to date within the ‘Online Members Hub’ or by informing a member of staff. The Council will not be responsible for address errors occurring because of failure by Season Ticket holders to keep contact details updated.

CATEGORY OF SEASON TICKET

3.1 All categories of Season Ticket, playing rights and associated costs are available on the website.

3.2 The Council may offer concessionary rates from time to time.  Applicants for such rates are required to provide appropriate documentary evidence of their eligibility.

METHODS OF PAYMENT

4.1 Season Ticket holders wishing to pay by subscription must do so by recurring card payment.

4.2 All subscriptions must be paid on either 1st or 15th day of each month. Paying by subscription you are agreeing to purchase a Season Ticket up to 31st March. The full amount due must be paid by 31st March.

4.3 If a scheduled payment fails, then the Council will attempt to make a one off payment within 5 days of the original payment date.

4.4 Any payments not received within seven days of becoming due, will result in the suspension of booking rights. If they remain unpaid after one month of becoming due this may result in an administration fee of £30 being applied to the Season Ticket holder’s account.

4.5 If they remain unpaid after two months, the Season Ticket will be cancelled. Any debt outstanding may be referred to the Council’s debt recovery team. A charge of £75 may be applied to the outstanding balance to cover administration fees.

MEDICAL SUSPENSION OF SEASON TICKET

5.1 A Season Ticket may be suspended due to injury/ill health upon production of a Doctor’s letter stating that they are unfit to play golf/use the facilities.

5.2 Upon death or a debilitating long term medical condition, your Season Ticket obligations to the Council will end. The balance of any advanced payments will be refunded following written notification being received.

CANCELLATION POLICY

6.1 All Season Ticket holders have a fifteen-day period in which to revoke a Season Ticket from the date of purchase and receive a full refund. If the Season Ticket holder has played during the period, then they will be responsible for the payment of all green fees at the full advertised Non-Member rate.

6.2 In the event that a Season Ticket holder, or the Council cancels a Season Ticket for any reason outside of the terms and conditions, any former Season Ticket holder wishing to re-join must first pay any fees outstanding plus an administration fee of £30.

6.3 Any former Season Ticket holder who has cancelled their membership out with the terms of cancellation may not be signed on at guest rate and will not be permitted to play in any Council organised Open competition or Open Week. They are not restricted from representing another club in a team match or from playing by paying a full green fee or from playing as a member of a visiting society.

6.4 A Season Ticket holder may apply to cancel their Season Ticket due to the circumstances set out in Section 5. In addition, any Season Ticket holder who can demonstrate financial hardship as a result of changed circumstances may apply to cancel their Season Ticket. If, in either of these circumstances, the Season Ticket holder has paid in full, a pro-rata refund for the remainder of the Season Ticket term will be given.

6.5 Season Ticket holder may apply to cancel their Season Ticket if they relocate to out with 50 miles of the South Ayrshire area and are able to provide proof of their new address. Accepted proof includes a recent Utility Bill, Bank Statement or Council Tax Bill.

6.6 South Ayrshire Council reserves the right to cancel or suspend a Season Ticket at any time in the following circumstances:

6.6.1 If a Season Ticket holder commits a serious or repeated breach of these Terms and Conditions.

6.6.2 If a Season Ticket holder knowingly provides false details which would have reasonably affected our decision to grant a Season Ticket to that individual.

6.6.3 If a Season Ticket holder harasses, threatens or abuses a Council Employee or other Season Ticket holder, maliciously damages property, or commits any illegal act whilst on the facilities.

6.7 No refund will be given for subscription payments received if Season Ticket is cancelled out with the terms of this cancellation policy.

BOOKING A TEE TIME

7.1 Tee times are subject to availability, Season Ticket holders may book a tee time up to 8 days in advance (online from 9pm on the eighth day prior to the date of booking) depending on the category of membership purchased. Bookings by phone or in person may be made up to 7 days in advance during clubhouse hours Seasonal variations may apply to clubhouse hours.

7.2 Non-Member reserved times may be booked at 9pm, two days in advance, if available.

7.3 Season Ticket holders must ensure they have fully read the terms of booking when booking online.

7.4 Each Season Ticket holder may only book one tee time per day per course.

NO SHOWS AND CANCELLATIONS

8.1 Season Ticket holders who fail to show for a booked tee time may have a charge of £5 levied to their account, unless the course has been closed by the Council.

8.2 Season Ticket holder who wishes to cancel a booked tee time must do so more than 2 hours in advance of that tee time. Season Ticket holders who cancel within 2 hours of the tee time, may have a charge of £5 levied to their account, unless the course has been closed by the Council.

GUESTS OF SEASON TICKET HOLDERS

9.1 Season Ticket holders wishing to introduce guests must observe all terms and conditions, in particular:

9.1.1 The Council reserves the right to refuse entry to guests who are former Season Ticket holders and whose Season Ticket has been revoked by the Council.

9.1.2 Guests must pay the appropriate fee as detailed in the list of Green Fees available on the website.

9.1.3 Guests must be accompanied on the course by the Season Ticket holder introducing them.

COURSE CLOSURE / INCLEMENT WEATHER

10.1 The course(s) or practice areas may be closed due to adverse weather conditions or for competitions. The Council may, from time-to-time close holes or parts of holes for the purposes of maintenance, repairs or improvements of the course

HEALTH AND SAFETY

11.1 The Council will endeavour to take reasonable care to provide a safe environment for Season Ticket Holders and guests. Season Ticket holders and guests must abide by the rules of golf and obey all Council signage and instructions placed on notices.

11.2 Due care and attention should always be demonstrated when accessing the courses, including checking the playing surface of the golf course is suitable to play, before commencing.

OPENING TIMES

12.1 The Council reserves the right to vary the times of opening and closing of facilities, times are listed on the website and published on notice boards.

INSURANCE

13.1 All Season Ticket holders and their paying guests are provided personal liability insurance for playing golf on a golf course owned by the Council in respect of third-party injury, property damage and personal accident. All rounds of golf must be pre-booked for this insurance to be applicable.

13.2 All incidents or accidents, including where a golf ball has left the confines of the course, must be reported to a member of staff.

APPLICATION OF CONDITIONS AND OUR OBLIGATIONS

14.1 These Season Ticket Terms and Conditions shall not affect your statutory rights.

14.2 The Council shall send notifications to Season Ticket holders by email and by updates to its website advising of any changes to these terms and conditions out with the membership renewal period.

COMPLAINTS

15.1 Complaints should be brought to the immediate attention of a member of staff. All complaints will be dealt with through the Council’s Complaints handling procedure.

RIGHT OF APPEAL

16.1 All Season Ticket Holders have the right of appeal to any decision taken under these terms and conditions of membership. Appeals in the first instance, should be made in writing to:

HOW INFORMATION ABOUT SEASON TICKET HOLDERS WILL BE USED

17.1 All personal information supplied to the Council will be used only to administer your Season Ticket account
